Bail

Before arrest and after it. Applications are prepared and argued before the Delhi district courts and the Delhi High Court.

Before arrest

Anticipatory bail is sought by a person who has reason to apprehend arrest in a non-bailable offence — usually after an FIR is registered, or after a notice arrives from the police. It is applied for before the Sessions Court or the High Court, and it cannot be applied for once arrest has already taken place.

The window matters. An application prepared before the police act is a different document from one drafted in a hurry after a team has arrived at the house.

After arrest

Regular bail is sought after a person has been taken into custody. What the court considers includes the nature of the offence, the stage of the investigation, the material placed on record, and whether custodial interrogation is still said to be required.

The position changes once the chargesheet is filed. Before it, the investigation is open and the prosecution argues that custody is needed. Afterwards, the material is on record, and the arguments available to the defence are different ones.

Proclaimed offender proceedings

A proclamation is issued where a person has not appeared despite process being served. It restricts the ordinary routes to bail and brings separate proceedings into play. In most such matters the first step is to address the proclamation itself rather than to apply for bail in the main case.

Custody parole

Custody parole is short, supervised permission for a person already in custody to leave for a specific purpose — commonly a death in the family, a serious illness, or a defined personal obligation. It is granted for a limited period, under escort, and the person remains in custody throughout.

What to bring

  • A copy of the FIR, if one has been registered
  • Any notice received from the police or an investigating agency
  • Arrest memo and remand papers, where an arrest has taken place
  • Copies of any earlier bail orders in the same matter

If none of these are available yet, obtaining them is itself the first step, and the chamber can begin there.

Common questions

What is the difference between anticipatory bail and regular bail?

Anticipatory bail is sought before arrest, by a person who apprehends arrest in a non-bailable offence. Regular bail is sought after a person has already been taken into custody. The court approached, the documents required and the timing are different in each.

When should anticipatory bail be applied for?

Once there is a reasonable apprehension of arrest — typically after an FIR is registered, or after a notice is received from the police. It cannot be applied for after arrest has already taken place; at that stage the application is for regular bail.

Which court hears a bail application?

Depending on the offence and the stage, a bail application may lie before the Magistrate, the Sessions Court, or the High Court. Anticipatory bail is applied for before the Sessions Court or the High Court. In some categories of offence the matter goes before a designated Special Court.

Does bail become easier once the chargesheet is filed?

Not automatically, but the position does change. Before the chargesheet, the investigation is still open and custodial interrogation is often argued as necessary. Once the chargesheet is filed, the material is on record and the arguments available to the defence are different.

What happens if someone has been declared a proclaimed offender?

A proclamation is issued where a person has not appeared despite process being served. Being declared a proclaimed offender restricts the ordinary routes to bail and brings separate proceedings into play. The first step is usually to address the proclamation itself rather than to apply for bail in the main case.

What is custody parole and when is it granted?

Custody parole is short, supervised permission for a person in custody to leave for a specific purpose — commonly a death in the family, a serious illness, or a defined personal obligation. It is granted for a limited period and the person remains in custody throughout, escorted by police.
